RERA complaint against builder: filed, argued and resolved for one flat fee
If your builder has delayed possession, is holding your money, or sold you a flat on promises they have not kept, you can file a complaint before your State's Real Estate Regulatory Authority (RERA). We draft the complaint, file it, and appear for you at the first hearing for a flat professional fee of 8,000 rupees, agreed in writing before we begin. That single fee covers the whole of getting your matter properly on the record and heard. There is no hourly billing, and nothing is added on quietly later.
Adv. Bhawna Yadav and her team handle each RERA complaint personally. You deal with a named advocate who has actually read your file, not a call centre.
What a RERA complaint actually is
The Real Estate (Regulation and Development) Act, 2016 gave homebuyers a fast, buyer-friendly forum of their own. Instead of waiting years in an ordinary civil court, an allottee can approach the State RERA Authority directly and ask for specific relief against a registered project or promoter. The Authority can order refunds, direct payment of interest for every month of delay, and hold a builder to what was promised.
A RERA complaint is a written, well-pleaded application. It sets out who you are, what you booked, what you paid, what the builder committed to, and exactly what went wrong. The quality of that drafting matters enormously. A complaint that clearly pins the builder to the agreement and the correct provisions of the Act moves faster and lands harder than a vague grievance letter. That drafting is the heart of what we do.
When you can file a RERA complaint against your builder
Most builder disputes fall into three well-recognised grounds. Your matter may involve one of them, or several at once.
Delayed or denied possession
This is the most common reason buyers come to us. The agreement promised possession by a certain date, that date has passed, and the flat is nowhere near ready, or the builder keeps moving the goalposts. Under the Act you do not have to simply absorb that delay. You can insist on possession with interest for the delayed period, or, if you no longer want to wait, step out of the project and demand your money back with interest.
Refund with interest
If the project is stalled, the builder has effectively abandoned it, or you have simply lost confidence and want out, you can seek a refund of everything you have paid, together with interest at the rate the Act prescribes. Builders often agree to a refund and then quietly drop the interest, or stretch repayment over an open-ended schedule. We make sure the claim for interest is on the record and argued, not waived.
False promises and misrepresentation
A glossy brochure, a model flat, and a sales pitch full of amenities that never materialise are a real and provable grievance. If you were sold a specific layout, area, clubhouse, or delivery timeline and the reality is different, the Act treats that as misrepresentation and gives you a remedy, including walking away and recovering your investment with interest.
Our flat fee and what it covers
Our fee for a RERA complaint is a flat 8,000 rupees. We tell you that figure up front and put it in writing before any work starts, so there is never a moving target.
For that one fee, we:
- Read your full file, including the builder agreement, allotment letter, payment receipts, demand letters, and all correspondence
- Identify the strongest grounds available to you under the Act
- Draft a clear, properly pleaded complaint with the correct reliefs
- File it before the relevant State RERA Authority with the supporting record in order
- Appear for you at the first hearing and press your case
Only further hearings, if the Authority requires them, are charged beyond this, and we quote those to you in advance, in writing, before we continue. You will always know the number before it is spent.
Here is the part we want to be very clear about: we do not pad the bill. Plenty of firms treat every matter as an open meter and find reasons to keep it running. We do the opposite. We quote one fee, we tell you honestly what your matter actually needs, and if your case is straightforward we say so. We respect your time and our own effort, and we would rather earn your trust than a few extra rupees.
Who this is for
This service is built for individual homebuyers and allottees, the very people the Act was written to protect. You will find it useful if:
- You are staring at a broken possession date. The handover was due, it has passed, and you are still paying rent or an EMI on a home you cannot move into.
- Your project has stalled. Construction has slowed to nothing, the site is quiet, and you want your money back before more of it is at risk.
- The builder is dangling a refund without interest. They will return your principal but expect you to forgive months or years of your money being locked up.
- You were sold one thing and given another. The carpet area, the tower, the amenities, or the timeline you were promised do not match what is being delivered.
- You are a joint buyer, or a family that pooled its savings into one booking, and you need the claim framed correctly so everyone's interest is protected.
If your dispute is with a co-operative society, an unregistered plot sale, or a purely contractual matter outside RERA, tell us. We will say so honestly and point you to the right remedy rather than filing something that does not belong before the Authority.
What you get with Adv. Bhawna Yadav and her team
When you engage us you get a real, named advocate and a small team that stays with your matter from the first reading to the first hearing.
- A complaint drafted to be argued, not just filed. Pleadings that anticipate the builder's defences and cite the right provisions.
- A clear written note of what you are asking for and the realistic timeline ahead, so you are never left guessing.
- Direct access. You can reach Adv. Bhawna Yadav and her team with your questions and get a straight answer.
- Plain-language updates. We explain each step in ordinary English or Hindi, without hiding behind jargon.
Adv. Bhawna Yadav is an Advocate and Legal Consultant enrolled with the Bar Council of Madhya Pradesh, holds a B.A. LL.B. and an LL.M., and qualified UGC-NET with JRF. Her chamber is at Arera Hills, Bhopal. That background matters most in the drafting, because a RERA complaint lives or dies on how tightly it is written.
How working with us goes
We keep the experience simple and calm.
First, we talk. You tell us what you booked and what went wrong, and you send across your documents. We read everything before we form a view. Then we tell you honestly whether you have a strong RERA matter, which grounds fit, and what relief is realistic, whether that is a refund, interest, possession, or a combination.
Once you decide to go ahead, we confirm the flat 8,000 rupee fee in writing and get to work on the drafting. You see the complaint before it goes in, and we refine it until it says exactly what your situation needs. We then file it before the correct State Authority and get your matter listed.
At the first hearing, we appear and argue your reliefs. Afterwards, we tell you plainly what happened and what comes next. If the matter needs more hearings, you will already know the cost before we take another step. Throughout, our focus is on the outcome you came for, your money back with interest or possession held to account, and not on stretching the file.
Available across India and for NRIs and clients abroad
RERA is a State subject, so complaints are filed before the Authority of the State where your project is located, whether that is Madhya Pradesh RERA, MahaRERA in Maharashtra, Karnataka RERA, UP RERA, or another. We work with clients across India and file before the appropriate State Authority for your project.
You do not need to be in the same city as us, or even in the country. We handle matters remotely, gather your documents digitally, and keep you updated wherever you are. For NRIs and clients abroad, who so often buy a home back in India and then struggle to hold a builder accountable from a different time zone, this is exactly the kind of matter we are set up to manage on your behalf. You send us the file, and we carry the fight in India.
If you would like to talk it through first, start with a consultation, and we will tell you honestly whether a RERA complaint is your best route. Where a firm letter might resolve things faster, we may suggest a legal notice first. We recommend what actually serves you.
Why choose us
- A named advocate. Your matter is handled by Adv. Bhawna Yadav and her team, not passed to whoever happens to be free.
- One flat fee. 8,000 rupees, agreed in writing before we begin, covering drafting, filing, and the first hearing.

- Buyer-side focus. We act for homebuyers and allottees, and we understand how builders defend these complaints.
The legal basis
RERA complaints are governed by the Real Estate (Regulation and Development) Act, 2016. A few provisions do most of the work in a builder dispute:
- Section 18 gives an allottee the right, where the builder fails to hand over possession on time, either to withdraw and recover the full amount paid with interest, or to continue and receive interest for every month of delay until possession is given.
- Section 12 allows you to recover your investment with interest where you booked on the strength of a false or misleading advertisement or prospectus that did not match the reality delivered.
- Section 31 is the provision under which an aggrieved allottee files a complaint directly before the State Real Estate Regulatory Authority.
- Section 43(5) provides the onward route, so that if either side is dissatisfied with the Authority's order, an appeal lies to the Real Estate Appellate Tribunal.
Knowing which of these to lean on, and how to plead it, is what turns a grievance into an enforceable order. That is the work we do for a flat 8,000 rupees, honestly quoted and fully explained, in English or Hindi, for buyers anywhere in India and abroad.

Frequently asked questions
How much does it cost to file a RERA complaint against a builder?
Our fee is a flat 8000 rupees, agreed in writing before we begin. It covers reading your file, drafting the complaint, filing it before your State RERA Authority, and appearing at the first hearing. There is no hourly billing, and only further hearings, if the Authority needs them, are quoted to you in advance.
Can you file my RERA complaint if I live in another city or abroad?
Yes. RERA complaints are filed before the Authority of the State where your project is located, and we work with clients across India and file before the correct State Authority for your project. You do not need to be in the same city as us. We handle documents digitally and keep you updated wherever you are, including if you are an NRI.
Can the complaint and hearing be handled in English or Hindi?
Yes. We draft, explain and correspond in English or Hindi, whichever you are comfortable with. You will always understand exactly what has been filed and what happens next, in plain language.
What can I claim in a RERA complaint against my builder?
Depending on your facts, you can seek possession with interest for the delayed period, a full refund of what you paid together with interest, or a remedy for false and misleading promises. We read your file first and tell you honestly which reliefs fit your matter before we draft anything.
My builder keeps delaying possession. Do I have a case under RERA?
If your agreement promised possession by a date that has now passed and the flat is not ready, you generally have a strong claim. The Real Estate (Regulation and Development) Act, 2016 lets you insist on possession with interest for the delay, or step out of the project and recover your money with interest. Send us the agreement and we will assess it honestly.
What if my builder offers a refund but refuses to pay interest?
This is common. Builders often agree to return the principal while quietly dropping the interest or stretching repayment over an open-ended schedule. Under the Act your money being locked up entitles you to interest, and we make sure that claim is on the record and argued, not waived.
How long does a RERA complaint take?
We aim to draft and file within one to two weeks of receiving your complete documents. After that, the hearing timeline depends on your State Authority's list. RERA was designed as a faster, buyer-friendly forum than an ordinary civil court, and we keep your matter moving and keep you informed.
