Anticipatory bail — protection before an arrest
Anticipatory bail is pre-arrest protection: a court order that says if you are arrested in connection with a specific matter, you are to be released on bail on set terms. It is what you seek when you have a real fear of being arrested — because an FIR has been filed against you, a complaint has been made, or a credible threat of one hangs over you. Adv. Bhawna Yadav and her team prepare and file your anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (earlier Section 438 of the CrPC) at a flat ₹35,000 — covering the consultation, the drafting, the filing before the Sessions Court or High Court, and the first hearing.
The fee is fixed and agreed in writing before any work starts. There is no hourly billing, nothing added quietly later, and no upselling. Unlike firms that pad the bill, we quote one fee and tell you honestly what your matter actually needs.
What anticipatory bail actually is
An ordinary bail is something you seek after an arrest. Anticipatory bail is the opposite — it is sought before an arrest, by a person who has reason to believe they may be arrested on an accusation of a non-bailable offence. If the court is satisfied, it passes a direction that in the event of arrest, the person shall be released on bail. The protection travels with you: it does not stop the investigation, but it means the fear of being taken into custody no longer controls your life while the matter is looked into.
This relief exists because the law recognises that not every accusation is true, and that the mere threat of arrest can be used to harass, pressure, or settle scores. Anticipatory bail is the safeguard against exactly that — a way to secure your liberty in advance while the process runs its course.
What our flat ₹35,000 covers
The flat professional fee is deliberately simple, so you know precisely what you are getting:
- A confidential consultation in which we understand the FIR, complaint, or threat you are facing and assess how strong your apprehension of arrest really is.
- Drafting the application — a carefully built anticipatory bail application in your name, setting out the facts, the grounds, and why the protection should be granted.
- Filing before the right court — the Sessions Court or the High Court, whichever your matter calls for.
- The first hearing — an advocate appears and presents the application when it is first taken up.
- A round of revisions to the draft before filing, and a certified copy of the order sent to you once it is passed.
If, and only if, the court fixes further hearings, we tell you in advance and quote them in writing. We respect your time and our own effort, so you will never find yourself billed by the hour or surprised by something added after the fact.
When you need anticipatory bail — and why speed matters
Anticipatory bail is almost always time-sensitive. The value of the protection lies in securing it before an arrest happens, not after. The moment you sense that arrest is a real possibility, that is the moment to act. These are the situations that most often bring people to us:
An FIR has been registered against you
You have learned that a First Information Report names you in a non-bailable matter. This is the clearest trigger. Once an FIR exists, the possibility of arrest is real, and moving quickly for anticipatory bail is how you stay in control of the situation rather than being caught by it.
A complaint has been made, or a threat issued
Sometimes there is no FIR yet, but a complaint has been filed with the police, or someone has openly threatened to have you arrested. Where that apprehension is genuine and specific, the law allows you to seek protection in advance. We assess whether your fear is strong enough to move on now, and we are candid if it is not yet ripe.
A false or motivated accusation
Disputes over property, money, business, or family can spill into criminal accusations that are exaggerated or entirely false. Anticipatory bail is the shield the law gives an innocent person against being arrested first and heard later. We build the application to show the court the true shape of the matter.
You are about to be called for questioning
When word reaches you that the police intend to act, the days that follow are the ones that matter. Acting before an arrest, rather than after, is what keeps you out of custody and lets you cooperate with the investigation from a position of safety.
In each of these, the common thread is urgency, and we treat anticipatory bail as the urgent work it is — usually ready to file within two to four days, and faster when the apprehension is immediate.
The conditions a court may impose
When a court grants anticipatory bail, it usually attaches conditions, and it is important to understand them before the order is passed. Courts commonly direct that you make yourself available to the investigating officer for questioning whenever required, that you do not directly or indirectly threaten any witness or tamper with the evidence, and that you do not leave the country without the court's permission. The court may also require you to furnish a personal bond with sureties.
These conditions are not a trap — they are the terms on which your liberty is protected, and complying with them fully is what keeps the protection intact. We explain each one to you in plain language, tell you exactly what it means for your daily life, and make sure you understand your obligations so the order continues to protect you.
What you get with Adv. Bhawna Yadav and her team
You are not handed to a call centre or a rotating desk. You get a named advocate — Adv. Bhawna Yadav, enrolled with the Bar Council of Madhya Pradesh, with her chamber at Arera Hills, Bhopal — and her team, working on your matter directly. That means:
- A real assessment of your apprehension and the strength of your position, given to you honestly rather than dressed up to win the engagement.
- An application drafted with care, built on the facts of your matter and the grounds that count, not a template with your name dropped in.
- The first hearing conducted for you, with the application presented properly when it is taken up.
- Clear communication at every step, in English or Hindi, so you always know what is happening and what comes next.
How working with us goes
The process is designed to be fast and calm, because that is what an anticipatory bail matter needs. It begins with a confidential consultation, over a call or video, where we listen to the whole story — the FIR or complaint, the people involved, and the outcome you fear. We tell you frankly whether anticipatory bail is the right step and which court to approach.
From there we draft the application, share it with you for your input, and refine it. Once you are satisfied, we file it before the appropriate court and appear when it is first heard. When the order is passed, you receive a certified copy and a plain-English explanation of any conditions attached to it, along with clear guidance on what to do next. Throughout, you deal with an advocate, not a portal — the outcome you receive is a filed application, a hearing conducted, and, when granted, an order that protects your liberty.
Available across India, and for NRIs and clients abroad
You do not need to be in Bhopal, or even in India, to instruct us. We act for clients in every Indian state, and for NRIs and clients living abroad who face a matter back home. The consultation happens over a call or video, documents are exchanged securely and digitally, and we file before the court that has jurisdiction over your matter. Wherever you are, the work is handled with the same care and at the same flat ₹35,000. If you are overseas and worried about a case in India, a quick consultation is the fastest way to understand whether anticipatory bail is the right move.
Why choose us
An anticipatory bail matter is not the place for uncertainty about who is doing the work or what it will cost. With us you get a named advocate and her team, one flat fee of ₹35,000 agreed in writing before we start, and a firm promise of no upselling — we quote one fee and tell you honestly what your matter actually needs, rather than manufacturing hearings to grow the bill. You are looked after in English or Hindi, kept fully informed, and treated with the urgency and the confidentiality a matter like this deserves. If your situation turns out to need a formal reply to a complainant as well, we can advise on legal notice drafting separately and transparently.
After the order — what the protection means for you
Once anticipatory bail is granted, the practical change is immediate: the shadow of a sudden arrest lifts. If the police do move to arrest you in that matter, the order requires that you be released on bail on the terms the court has set. That is a profound relief, but it is not a licence to ignore the investigation. The protection holds only while you honour the conditions attached to it — being available when the investigating officer needs you, staying away from witnesses and evidence, and remaining within the country unless the court permits otherwise.
We do not simply hand you the order and disappear. We walk you through what it means in your everyday life — what you can do, what you must avoid, and how to respond if the investigating officer contacts you — so the protection you have secured stays intact. The aim is that you cooperate with the process from a position of safety, rather than fear.
Anticipatory bail and the case itself
It is important to be clear-eyed about what this relief does and does not do. Anticipatory bail protects your liberty; it does not close the underlying matter. The investigation can continue, and where the accusation ultimately becomes a case, that case has to be answered on its own footing. What anticipatory bail buys you is the freedom to face the matter without the fear of custody hanging over every step.
Because we tell you the truth about your situation, we will always explain honestly where the anticipatory bail ends and the defence of the matter begins. If your case needs representation beyond this stage, we scope and quote that separately and transparently, in writing, before any further work — never bundled in, never assumed. A short consultation is often the best way to understand the road ahead before you commit to anything further.
The legal basis
Anticipatory bail is provided for under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) — the provision that replaced Section 438 of the Code of Criminal Procedure, 1973, when the new criminal codes came into force. Under it, a person who has reason to believe they may be arrested on an accusation of a non-bailable offence may apply to the High Court or the Court of Session for a direction that, in the event of arrest, they be released on bail. The court weighs factors such as the nature and gravity of the accusation, the applicant's background, and whether the accusation appears to be made to injure or humiliate the person, and it may grant the protection on suitable conditions. We build your application squarely within this framework so it stands on solid legal ground.

Frequently asked questions
What does the flat ₹35,000 cover, and is anything added later?
The flat fee covers the full consultation, drafting your anticipatory bail application, filing it before the correct court, and appearing at the first hearing. It is our one professional fee, agreed in writing before we begin. If the court fixes further hearings, we tell you honestly and quote them in advance — nothing is added quietly and there is no hourly billing.
Do I need an FIR before I can apply for anticipatory bail?
Not always. Anticipatory bail is protection against arrest, and you can apply when you have a genuine apprehension of arrest — whether an FIR has been registered or a serious complaint or threat exists that could lead to one. We assess in the consultation whether your apprehension is strong enough to move now, and act quickly if it is.
Can you handle my anticipatory bail if I am in another state or abroad?
Yes. We act for clients across every Indian state and for NRIs and clients living abroad. The consultation is held over a call or video, documents move digitally, and we file before the court that has jurisdiction over your matter. Distance does not change the flat ₹35,000.
Can the whole matter be handled in Hindi?
Yes. We work with you in English or Hindi, whichever you are comfortable in, and we explain every step and every condition in plain language so you always know exactly where you stand.
How quickly can you file the application?
Anticipatory bail is usually urgent, and we treat it that way. In most matters we are ready to file within two to four days of the consultation and receiving your documents — often sooner where the apprehension is immediate. The moment your matter needs speed, that is how we handle it.
What conditions can the court impose when it grants anticipatory bail?
Courts commonly direct that you make yourself available for questioning by the investigating officer, that you do not threaten witnesses or tamper with evidence, and that you do not leave India without permission. There may be a direction to furnish a bond and sureties. We explain each condition clearly and advise you on complying with it fully.
What happens if the Sessions Court refuses my application?
A refusal at the Sessions Court is not the end of the road — the High Court can be approached for the same relief. In the consultation we advise you honestly on the right court to begin with and on your options if the first application does not succeed, so you go in with a realistic view rather than a false promise.
Is what I tell you kept confidential?
Completely. Everything you share is covered by advocate–client confidentiality from the first conversation. You can speak frankly about the FIR, the complaint, or the people behind it, knowing it stays between you and your advocate.
