Child custody petition under the Guardians and Wards Act
A child custody petition is the formal request to a court to decide who a child will live with and who is responsible for their care and upbringing. Adv. Bhawna Yadav and her team draft your petition, file it before the correct court, and represent you at your initial hearings — all at a flat professional fee of ₹30,000, agreed in writing before we begin. There is no hourly billing, nothing padded on later, and no upselling.
Few things are harder than a dispute over a child. What you need at that point is calm, clear guidance and someone who will act — not confusion about cost or process. We give you a named advocate, one honest price, and a petition built around the one thing the law cares about most: your child's welfare.
What a child custody petition is
When parents separate, divorce, or fall into dispute over a child, the question of where the child lives and who cares for them has to be settled. Sometimes parents agree and simply want that agreement recognised. Often they do not agree, and the matter has to be placed before a court to decide. A custody petition is how that decision is asked for.
The petition sets out who you are, who the child is, the child's present circumstances, and the custody or guardianship you are seeking — and, crucially, why the arrangement you propose serves the child's welfare. The court is not choosing between two adults on the strength of their claims. It is deciding what is genuinely best for a child who cannot speak fully for themselves, and a well-built petition is what puts your child's real interests clearly before it.
Because a child's care often cannot wait for a full matter to conclude, custody proceedings frequently begin with a request for interim arrangements — a temporary custody or visitation order that holds the position steady while the case is heard. Getting that opening step right matters, and it is exactly the part we take off your hands.
Types of custody, in plain terms
Custody is not a single thing. Understanding the forms it can take helps you know what to ask a court for, and we advise you on which fits your family.
Physical custody
This is what most people mean by custody — the child lives with one parent, who has day-to-day care of them, while the other parent typically has defined visitation or contact. It gives the child a settled home base while preserving the relationship with the other parent.
Joint custody
Here both parents share the child's care, often on an agreed schedule, so the child spends meaningful time with each. Joint arrangements work best where parents can cooperate, and courts increasingly recognise the value to a child of keeping both parents closely involved.
Legal custody
This concerns decision-making authority — schooling, medical care, religion, and the major choices in a child's life — as distinct from where the child physically lives. Legal custody can rest with one parent or be shared, and it does not always follow physical custody.
Interim and temporary custody
Where a child's immediate care or safety is at stake, a court can pass a temporary order at the start of the case, settling who the child stays with and what contact the other parent has while the full matter is decided. We seek this at the outset whenever your child's situation calls for it.
The welfare of the child decides it
Every custody matter in India turns on a single, overriding principle: the welfare of the child is paramount. This is not a slogan — it is the legal test the court actually applies, and it outranks the wishes, convenience, or claims of either parent.
In weighing welfare, a court looks at the whole picture of the child's life. The child's age and needs, the emotional bond with each parent, the stability and safety each home offers, the child's education and health, the character and conduct of each parent, and the child's own preference where they are old enough to form one — all of it feeds into the decision. No single factor is decisive; the court balances them in the child's interest.
Because welfare is the test, a custody petition is only as strong as its picture of the child. We do not file a template. We take the time to understand your child and your situation, and we present the court with an honest, well-grounded account of why the arrangement you seek genuinely serves them.
A parent's rights — framed as the law frames them
There is a widespread belief that mothers automatically get custody of young children, and an equally common fear among mothers that a father with more resources will simply take the child. Both anxieties miss how the law actually works.
Indian law does not award custody by the parent's gender. A mother is not entitled to custody merely for being the mother, and a father is not disqualified for being the father. For very young children, courts often find that the child's welfare is served by the mother's care, but that is a conclusion drawn from the child's needs, not an automatic rule — and it can and does go the other way on the facts.
What this means in practice is that your case is not won or lost by which parent you are. It is made by how clearly your petition shows that the child's welfare is served by the custody you seek. We frame your matter on that footing, whichever parent you are, and we tell you honestly and early where your real strengths and challenges lie.
Our flat fee and what it covers
The fee is ₹30,000, flat. For that single figure we:
- sit with you to understand your child, your situation, and the custody you are seeking;
- draft the custody or guardianship petition under the law that applies to your family;
- file it before the Family Court or District Court that has jurisdiction;
- apply for interim custody or visitation where your child's care cannot wait; and
- appear and argue at your initial hearings.
We tell you this fee in writing before any work begins, and it does not move. A custody matter is, by its nature, an ongoing one — some conclude at an early stage, others run through several hearings over time. If your matter needs stages beyond the initial hearings, we tell you that honestly at the outset and quote any further stages to you in advance, in writing, so you are never surprised.
That honesty is the point. Some firms quote a low starting figure and then let a custody case run open-endedly, billing every appearance. We do the opposite: one clear fee for the defined work, a straight word about what your matter actually needs, and no pressure to buy more than that. We respect your time and the strain you are already under, and we respect our own effort enough to price it plainly.
Who this is for
This service is for any parent or guardian who needs a court to settle custody of a child. In practice, people come to us in situations like these:
- A parent after a separation or divorce who needs custody formalised so the child has a settled, recognised arrangement.
- A parent being denied contact with their child by the other parent and needing the court to restore or define visitation.
- A parent worried about the child's safety or wellbeing in the other parent's care, who needs interim protection quickly.
- A grandparent or close relative stepping in to seek guardianship where a child's parents cannot care for them.
- An NRI parent whose child is in India, or whose co-parent has moved the child, and who needs to act through a court from abroad.
- Two parents who have already agreed and simply want their arrangement recorded and recognised by the court so it holds.
If your situation is not on this list, it does not mean we cannot help — it means you should talk to us so we can tell you exactly where you stand.
What you get with Adv. Bhawna Yadav and her team
You get a named advocate who owns your matter from start to finish — not a file passed between strangers at the most sensitive time of your life. You get a petition drafted on your real facts and your child's real needs, filed before the right court, and argued at your initial hearings. Where your child's care cannot wait, you get an interim application moved at the outset. And you get every order explained to you in plain English or Hindi, so you always know exactly what the court has decided about your child — all at one flat fee, fixed in writing, with no upselling behind it.
How working with us goes
We keep it steady and human, because a custody matter is stressful enough without a lawyer who adds to it.
First, we speak with you — by call, video, or in person — and take the time to understand your child, your relationship with them, and what you are seeking. We ask for the papers that matter and tell you clearly what we need and why. Then we draft the petition around your child's welfare and your facts, file it before the court that can hear it, and, where the situation calls for it, seek an interim order so nothing about the child's care drifts while the matter proceeds. We appear at your initial hearings and, throughout, keep you informed in language you understand. When the court passes an order, we explain what it means for you and your child and what comes next.
You will not have to chase us for updates or decode legal jargon. That is our part of the bargain.
Available across India and for NRIs and parents abroad
The law that governs custody and guardianship is central legislation and applies across every Indian state, so wherever your child is, we can act — we file before the court that has jurisdiction over the matter. Our chamber is in Bhopal, but our clients are all over the country and beyond it.
We regularly act for NRIs and parents living overseas whose child is in India, or who are separated from a co-parent across borders. You do not need to fly down to instruct us. We take your instructions remotely, in English or Hindi, keep you updated at every step, and handle the court appearances here. Distance should never mean a parent loses their voice in their child's future.

The legal basis
Child custody and guardianship in India are governed principally by the Guardians and Wards Act, 1890, under which a court appoints or recognises the person responsible for a minor's person and property. For Hindu families, the Hindu Minority and Guardianship Act, 1956 applies alongside it, and other communities are governed by their respective personal laws. Where custody arises within a divorce, the court also has power to make orders about the children under the relevant marriage law, such as the Hindu Marriage Act, 1955 or the Special Marriage Act, 1954.
Running through all of these is one settled principle, affirmed repeatedly by the courts: in any question of custody or guardianship, the welfare of the child is the paramount consideration, and every other claim yields to it. That principle is the foundation on which we build your petition, and it is the standard by which your matter will be judged.

Frequently asked questions
How much does a child custody petition cost?
Our flat professional fee is ₹30,000. That one figure covers drafting the petition, filing it before the correct court, and appearing at your initial hearings. We agree it in writing before we begin, so there is nothing to work out later and no bill that grows on you.
Is custody decided by who the mother is or who the father is?
No. Indian law does not hand custody to a parent by gender. The single question the court asks is what serves the welfare of the child, and it weighs each parent's circumstances against that. We frame your petition around your child's genuine best interests, whichever parent you are.
What is the difference between custody and guardianship?
Custody is about who the child lives with and who cares for them day to day. Guardianship is the broader legal authority to take decisions for the child and manage their affairs. A petition can seek one or both, and we advise you on exactly what your situation calls for.
Can I get custody quickly if my child needs protecting now?
Where a child's immediate care or safety cannot wait for the full matter to run its course, we can apply for interim custody or interim visitation at the outset. The court can pass a temporary order to hold the position steady while the case is heard. We tell you honestly whether interim relief fits your facts.
Can you handle a custody case if I live in another city or abroad?
Yes. We act for parents across India and for NRIs and parents living overseas, and we file before the court that has jurisdiction over the child. You can instruct us over call, video, or email in English or Hindi, and we keep you updated at every stage without you needing to be present in person.
Will the case be handled in English or Hindi?
Both. We speak with you and explain everything in English or Hindi, whichever you are comfortable with, and every order and its terms are explained in plain language so you understand precisely what the court has decided about your child.
Does the child get a say in who they live with?
Where a child is old enough to form an intelligent preference, the court may hear and consider what the child wants, though the child's welfare remains the deciding factor rather than the preference alone. We prepare your matter with this in mind where it is relevant to your child's age.
Is custody permanent once the court decides?
A custody order settles the position, but it is not always the last word. If circumstances change materially, custody and visitation arrangements can be revisited by the court in the child's interest. We explain how settled or open your particular order is likely to be.
