Contested divorce — represented by a named advocate
A contested divorce is a divorce you file alone, on a legal ground recognised by the law, because the marriage cannot be ended by mutual consent — either the other spouse will not agree, or the terms of parting cannot be settled between you. Adv. Bhawna Yadav and her team represent you through it, drafting and filing your petition on the ground that fits your facts and appearing at the initial hearings that open the matter, at a flat professional fee of ₹40,000.
The fee is fixed and agreed in writing before any work starts. Because a contested divorce is an ongoing matter, the stages beyond the opening are scoped and quoted in advance, in writing, as the matter reaches each one. There is no hourly billing, nothing added quietly later, and no upselling. Unlike firms that pad the bill, we quote one fee and tell you honestly what your matter actually needs.
What a contested divorce actually is
Most people hope a marriage can end cleanly. When both spouses agree, it can — through a mutual consent divorce, which is faster, calmer and far less costly. A contested divorce is what the law provides when that is not possible: when one spouse wants the divorce and the other will not consent, or when consent exists in principle but the terms around money, property or children cannot be agreed.
In a contested divorce, you ask the court to dissolve the marriage on a specific statutory ground, and you must be prepared to establish that ground. It is an adversarial process by nature, and it unfolds in stages over time rather than in a single hearing. That is precisely why it needs an advocate who will open it correctly, tell you the truth about the road ahead, and keep the fee honest at every turn.
Contested versus mutual — which one is yours
If you and your spouse genuinely agree that the marriage is over and can settle the terms, a mutual filing is almost always the better path, and we will say so plainly. Our mutual consent divorce petition is built for exactly that situation. A contested divorce is the right route only where consent is not available — and part of our job in the first consultation is to tell you honestly which of the two your situation really is, rather than pushing you toward the more expensive fight when the calmer path is open.
What our flat ₹40,000 covers
The flat professional fee is deliberately simple, so you know precisely what you are getting at the opening of the matter:
- A confidential consultation in which we understand your marriage, the ground you have, and the outcome you are seeking — including any concern about maintenance, property or children.
- Drafting the petition — a carefully built contested divorce petition in your name, set out on the statutory ground that genuinely fits your facts, with the supporting narrative the court needs.
- Filing before the right court — the family court that has jurisdiction over your matter.
- The initial hearings — an advocate appears and presents the petition as the matter is opened before the court.
- A round of revisions to the draft before filing, and a written, staged plan so you can see the road ahead and know the fee for each stage before it begins.
Because a contested divorce is an ongoing matter, the fee covers the opening of your case fully and cleanly. Everything past that point — the evidence stage, cross-examination, final arguments, and any interim applications — is scoped and quoted in advance, in writing, as your matter reaches it. You will never find yourself billed by the hour or surprised by something added after the fact.
Who a contested divorce is for
A contested divorce is not a single situation but a family of them. These are the ones that most often bring people to us.
Your spouse will not agree to a divorce
You have decided the marriage is over, but your spouse refuses to consent to end it. Consent cannot be forced, so a mutual filing is closed to you. A contested petition on a valid ground is the way the law lets one spouse seek a divorce the other will not agree to.
The marriage has become impossible to live in
Where there has been cruelty — physical or mental — or the other spouse has deserted you, or there has been adultery, the law recognises these as grounds on which a divorce may be sought. We assess your facts honestly against the ground and build the petition on the footing the evidence can actually support.
You cannot agree on money, property or children
Sometimes both spouses want out, but the terms are the problem — maintenance, alimony, the division of property, or the custody of children. When those cannot be settled, the matter becomes contested even if the wish to separate is shared. We open the divorce and advise you on the applications that protect your position on maintenance and custody as the matter proceeds.
You need protection while the matter runs
Where safety, finances or a child's welfare are at stake, interim relief may be needed quickly — maintenance to live on, custody or visitation arrangements, or an order restraining the other spouse. These are raised through separate applications, and we tell you clearly and in advance if your matter needs them, so you are protected without being surprised by the fee.
What you get with Adv. Bhawna Yadav and her team
You are not handed to a call centre or a rotating desk. You get a named advocate — Adv. Bhawna Yadav, enrolled with the Bar Council of Madhya Pradesh, with her chamber at Arera Hills, Bhopal — and her team, working on your matter directly. That means:
- A real assessment of your grounds and your position, given to you honestly rather than dressed up to win the engagement.
- A petition drafted with care, built on the facts of your marriage and the ground that genuinely fits, not a template with your name dropped in.
- The initial hearings conducted for you, with the petition opened and presented properly before the court.
- Clear communication at every step, in English or Hindi, so you always know what is happening, what it will cost, and what comes next.
How working with us goes
The process is designed to be calm and honest, because a contested divorce is stressful enough on its own. It begins with a confidential consultation, over a call or video, where we listen to the whole story — the marriage, the breakdown, the ground you have, and the outcome you want. We tell you frankly whether a contested divorce is the right step, whether a mutual filing might still be possible, and which court your matter belongs before.
From there we draft the petition, share it with you for your input, and refine it until you are satisfied. Once it is ready, we file it before the correct family court and appear as the matter is opened at the initial hearings. You deal with an advocate throughout, not a portal — what you receive is a filed petition, your matter properly opened before the court, and a clear written plan for the stages ahead, each one quoted before it begins.
Because this is an ongoing matter, we do not disappear after the opening. As the case moves toward evidence, cross-examination and final arguments, we set out what each stage involves and what it will cost, and nothing proceeds without your clear go-ahead. That is how the fee stays honest from the first hearing to the decree.
Why opening the matter properly matters
The way a contested divorce is started shapes everything that follows. The ground you plead, the facts you set out, and the reliefs you ask for at the outset are difficult to change freely once the matter is underway, and a petition drafted loosely can weaken your position for years. This is where an advocate earns her fee — not in filing a form, but in choosing the right ground, pleading it on facts the evidence can actually support, and framing the petition so your case is at its strongest from the first hearing.
We take that opening seriously because it is the foundation of the whole matter. A petition built carefully at the start is what keeps a contested divorce from drifting, and it is why we would rather spend the time to get the ground and the pleadings right than rush a filing to look busy. When the case later moves to evidence and argument, you are building on solid footing rather than repairing a shaky start.
Available across India, and for NRIs and clients abroad
You do not need to be in Bhopal, or even in India, to instruct us. We act for clients in every Indian state, and for NRIs and clients living abroad whose marriage or spouse is connected to India. The consultation happens over a call or video, documents are exchanged securely and digitally, and we file before the family court that has jurisdiction over your matter. Wherever you are, the work is handled with the same care, and the opening of your matter is covered by the same flat ₹40,000. If you are overseas and unsure whether your divorce must be contested at all, a short consultation is the fastest way to find out.
Why choose us
A divorce is not the place for uncertainty about who is doing the work or what it will cost. With us you get a named advocate and her team, one flat fee of ₹40,000 agreed in writing to open your matter, and a firm promise of no upselling — we quote one fee and tell you honestly what your matter actually needs, rather than inventing stages to grow the bill. Every stage beyond the opening is scoped and quoted in advance, so you always agree the fee before the work starts. You are looked after in English or Hindi, kept fully informed, and treated with the confidentiality and care a matter this personal deserves. Everything you share is covered by advocate–client confidentiality from the very first conversation.
If, after speaking with us, your situation turns out to be one both spouses can settle after all, we will guide you toward a mutual consent divorce petition instead — because the right advice, not the bigger fee, is what earns your trust.
The legal basis
A contested divorce is sought under the statute that governs your marriage. For marriages solemnised under the Hindu Marriage Act, 1955, the grounds for divorce are set out in Section 13 of that Act and include cruelty, desertion, adultery, conversion, and mental disorder, among others. Marriages under the Special Marriage Act, 1954 are governed by the grounds in Section 27 of that Act, and other personal laws contain their own comparable provisions. Where maintenance, alimony or the custody of children arises, it is dealt with under the maintenance, alimony and custody provisions of the applicable law, and, where relevant, the protections available under the Protection of Women from Domestic Violence Act, 2005.
We identify the statute and the ground that genuinely apply to your marriage, and we build your petition squarely within that framework so it stands on solid legal ground from the day it is filed.

Frequently asked questions
What does the flat ₹40,000 cover, and is anything added later?
The flat fee covers the full consultation, drafting your contested divorce petition on the ground that applies to you, filing it before the correct family court, and the initial hearings that open the matter. It is our one professional fee, agreed in writing before we begin. A contested divorce is an ongoing matter, so the stages beyond that are scoped and quoted in advance in writing — nothing is added quietly and there is no hourly billing.
What is the difference between a contested and a mutual divorce?
A mutual divorce is filed jointly when both spouses agree to separate and agree on the terms. A contested divorce is one you file alone, on a legal ground, because the other spouse will not consent or the terms cannot be agreed. If your situation is genuinely amicable, a mutual filing is faster and cheaper, and we will tell you so — see our mutual consent divorce petition. Where consent is not possible, a contested petition is the route, and that is what this service is for.
What are the grounds for a contested divorce in India?
For marriages under the Hindu Marriage Act, 1955, the recognised grounds include cruelty, desertion, adultery, conversion, mental disorder, and certain others set out in the Act. The Special Marriage Act, 1954 and other personal laws have their own comparable grounds. In the consultation we identify the ground that genuinely fits your facts and build the petition around it, rather than making a claim the evidence cannot carry.
How long does a contested divorce take?
A contested divorce is an ongoing matter and its length depends on the court, the ground, and how strongly it is opposed — it is measured in stages rather than a single fixed date. We give you an honest, realistic view at the outset instead of a false promise, and we tell you what each stage involves before it begins, so there are no surprises about time or fee.
Can you handle my contested divorce if I live in another state or abroad?
Yes. We act for clients in every Indian state, and for NRIs and clients living abroad whose marriage or spouse is connected to India. The consultation is held over a call or video, documents move securely and digitally, and we file before the family court that has jurisdiction over your matter. Distance does not change the flat ₹40,000 for the work this fee covers.
Can the whole matter be handled in Hindi?
Yes. We work with you in English or Hindi, whichever you are comfortable in, and we explain every stage, every ground and every option in plain language so you always know exactly where your matter stands.
Can I claim maintenance, alimony or custody as part of a contested divorce?
Yes. Alongside the divorce itself, the law lets you seek maintenance or alimony and, where there are children, custody and visitation. These are usually raised through separate applications within the proceedings. If your matter needs them, we tell you clearly, explain what each involves, and quote that work in advance in writing — we never assume it or bundle it in quietly.
What happens after the initial hearings you cover?
A contested divorce continues through pleadings, evidence, cross-examination and final arguments. Because it is an ongoing matter, we scope those stages and quote them in advance, in writing, as the matter reaches each one — so you always agree the fee before the work starts. We respect your time and our own effort, so nothing moves forward without your clear go-ahead.
